Dealing with Real Estate during Probate

When an owner dies, property can pass through the Probate Court process.  Probate becomes a necessary step when property is not conveyed before death.  Real property can be conveyed into a Trust by the owner as part of Estate Planning in order to avoid the Probate process. 

Owners should consult their legal professionals to understand the best way to hold property and how to handle the property in their estate after death.  A written will that conveys real property may have to be probated by the court.

Duties of an Executor
